The partners of Kammoun & Kallel firm participated to the 59th Congress of the UIA (International Union of Lawyers) held in Valencia on 2015.
This conference brought together on one place a significant number of lawyers from around the world to discuss the legal news affecting several areas of law including:
1- MERGERS AND ACQUISITIONS / CORPORATE LAW: FUNDING, ACQUISITION AND RESTRUCTURING OF CLUBS AND SPORT ACTIVITIES
Clubs and sports activities constitute today the economic assets that require funding and are subject of complex merger and acquisition transactions.
Financing, transfer and restructuring transactions related to clubs and sports activities raise complex legal issues that the Mergers and Acquisitions Committee and the Corporate Law Committee jointly addressed at this Congress with the support of experienced lawyers as well as sports clubs managers and in-house legal advisers.
2- INTERNATIONAL ARBITRATION
This session, divided into two panels, addressed various issues that the arbitrators can be exposed to during the different stages of the arbitral proceedings.
The first panel focused on issues related to the constitution of the arbitral tribunal and the relevant procedure. Other controversial issues, such as “waiver letters” regarding disclosure obligations and independence of arbitrators, the use of a secretary by the court, the admission (or not) of new applications and the bifurcation procedures were also discussed.
The second panel addressed issues may arise when it comes to decide a case or a request. Different stakeholders have considered some difficulties related to the concepts of iura novit curia and fair trial, unanimously and dissenting opinions, as well as difficulties related to the financing of the procedure by third parties and urgent arbitration proceedings.
Several other technical sessions and workshops led by more than 300 international speakers were also organized and encompassing other areas including business law, practice of law, human rights, competition law, insurance law, etc.
